Notice Of Public Comment - Request For Release of Funds


REQUEST FOR RELEASE OF FUNDS

On or about June 23, 2025, the Maine State Housing Authority will authorize Community Concepts Inc. to submit a request to the U.S. Department of Housing and Urban Development (HUD) Community Planning and Development, for the release of funds from Community Project Funding Program B-24-CP-ME-1102 under the Consolidated Appropriations Act, 2024 (P.L. 118-42) to undertake a project known as Brownfield Apartments.
The project site is 20 and 26 MacDonald Court, Brownfield, Oxford County, Maine. The Site consists of an approximate 9.36- acre parcel. The Site is identified by the town of Brownfield Tax Assessor's Office as Lot 25B on Property Tax Map U-11. There are two four-unit multifamily dwellings, a laundry/storage building, and wooded areas on the Site. The multifamily dwellings were constructed between 1986 and 1998 and renovated in 1998.
This is a maintenance and rehabilitation project for the two four-unit multifamily dwellings. Including: retro file all lighting, overlay paving, replace oil-fired boilers, replace flooring, re-side buildings, replace entry doors, replace porches and steps, upgrade bathrooms, upgrade kitchens –including appliances, tree removal, replace water lines, painting.

Estimated sources of funds for the project, Community Project Funds $448,400.


The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 24 CFR 58.35(a)(3)(ii). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Maine State Housing Authority and will be made available to the public for review either electronically or by U.S. mail. PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Maine State Housing Authority, 26 Edison Drive, Augusta, Maine 04330, Attention: Environmental Review Coordinator. All comments received by June 20, 2025, will be considered by the Maine State Housing Authority prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION
Maine State Housing Authority certifies to HUD that Daniel Brennan in his capacity as Director of Maine State Housing Authority consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Community Concepts Inc to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the Maine State Housing Authority’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Maine State Housing Authority; (b) the Maine State Housing Authority has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Boston at [email protected]. Potential objectors should contact HUD Boston via email to verify the actual last day of the objection period.
